Developer Transition

The transition of control of associations from declarants to unit owners is a process which requires professional guidance. Unit owners may not be aware of what rights they have when they take over control, and what obligations declarants have to them. Many declarants are happy that the unit owners don’t know this. We guide associations and their unit owner boards through this process by holding declarants accountable to fulfill their obligations to associations as required by Connecticut. We will also monitor, guide and advise boards about their remedies for construction defects (called warranty claims) and guidelines that must be adhered to which are triggered by the transition of control in order to properly assert claims that may arise related to declarant construction activity.
